I just got off the phone with Kristen Johnson (Communications Dept) and it was a very enlightening and good conversation. Let's just say it's really not home office against the free world...they are VERY aware of the BoB site and for the most part agree that it is a great reference site. Where we continue to disagree is that there are some people in the HO that still feel we are trying to associate ourselves with the company by name - on the internet - ie: advertising our affiliation. And I don't think there's any way to change that perception - even though we work extremely hard to POLICE our own usage of the name on a daily basis - there is the appearance of association with our particular company just because everyone is so excited and wants to share that excitement. The best I can do is what I have already (and always have) done - the disclaimer on the very opening page of Best of the Boards, and the footer disclaimer at the bottom of every page on BoB, and to continue to "police" the message board posts for incorrect or inaccurate information or usage of the company name.

Again - the only way I think this will ever change is to continue to show the positive influence of the internet - even when we agree to disagree. Belinda, webmaster

Another Letter from Home Office.
Sorry Canadian Consultants - I received another letter from the Communications Department this morning with a specific *request* to remove the link to the Canadian Extranet. They even printed off the page and highlighted it.

I am going to reproduce the letter itself here in hopes that any of you who are considering creating a webpage for yourself will be more aware of the possible ramifications.

It has been brought to our attention that you have been advertising on the Internet. Please be advised that this is our second request asking you to discontinue using the Internet in connection with [company].

I know that you are aware of [company's] policies and procedures regarding the Internet and misuse of [company] trademarks. You are also aware that we have an obligation under the trademark law to police our various trademarks against anyone who may, even inadvertently, use them without our permission. It is our opinion that you are infringing upon our exclusive trademark rights. We are obligated under law, even though it may seem somewhat harsh, to ask you to please immediately cease and desist in this matter. I have enclosed a page from your site, "Best of Boards" and highlighted the Canadian [Company] Extranet Link we would like you to remove.

You are a valuable part of our ["Company"] family and we thank you in advance for your cooperation in this matter. If you have any further questions, please do not hesitate to contact me.

While I certainly don't see how the link named "PL Extranet" could be a trademark infringement, and there is/was no use of the logo, as you can see I have no choice but to remove it. There was also one other page printed and included and highlighted - the Domain/ACS Page where I had the address to send ACS contributions directly to the Communications Dept. I had spelled out the company name BUT included the registered trademark symbol, and apparently that is still not acceptable. So it is also being removed.

Although I think the first paragraph is meant to be an official warning ("second request") that my consultant agreement may be in jeopardy, the remainder of the letter at least kept me from dissolving into a puddle like the letter I received in January did. Perhaps there is a smidge of respect for what we have created in this site.

I will of course, comply with the terms of the letter and will again phone Kristen Johnson back on Monday. Perhaps this time I will not get voice mail, or if I do, maybe I'll get a returned call.

Honestly - when I saw a letter from the company in my mail this morning I was excited because I thought it might be a response from Dianne regarding the three page letter I attached to the ACS checks at conference. It's so discouraging to try so hard to follow
the letter of the law and still be reprimanded for it. Oh well. It's still a great company and they ARE just protecting all of our interests in it. We just have to continue to be a positive influence from the net - and prove to them that THEY also need to "take
off the blinders".

Turning over the ACS checks to PL Help Desk in Vegas Saturday, July 22, 2000

Remember the sign-in poster from the Friday Night Fling? Well, it was turned over to the Conference Help Desk Staff along with all the ACS checks and PayPal donations (seen in the lower right hand corner of the poster - wrapped in a letter to Dianne B. with my BoB business cards for identification) on Saturday afternoon, July 22, 2000.

I WILL get the total finalized this weekend as well as other pictures posted (I WILL I WILL I WILL!!!), but in the meantime - click on the picture for a close up view of the poster - can you find YOUR name?
